3/15/05 Updated information - The developer has withdrawn
his application for a change in land use, but is still seeking a zoning
change to allow 5 single family detached houses on this 1.48 acre parcel.
The Board of Commissioners is scheduled to vote on this proposal on Tuesday,
March 22, 2005.

neighbors,
Please share this information with your friends and neighbors so that
everyone can be informed of what is happening in our area. Your
support is
greatly appreciated and needed.
Such an enormous community effort went into the defeat of the townhomes
on
Lavista Road at Nalley Circle. As you may be aware the developers
have
filed a lawsuit against the County over this denial. The outcome
of that
case is now under threat. This same developer has optioned the property
at
3098 Lavista Road (referred to by many as the woodcutter property) to
a
builder seeking to punch in another cul de sac development. The same
attorney that filed suit on the Lavista/Nalley property is handling the
application for this property.
The "word on the street" is that this attorney expects his win at 3098
Lavista to help win his case against Dekalb County on the Lavista/Nalley
property. A win for the developer on this property puts the rest of Lavista
Road at risk and will continue to set a precedent for other similar
applications along Lavista Road. We cannot afford to let this happen
to our
neighbors.
This application was denied at the recent Planning Commission meeting
by a
SLIM margin. Planning Commissioner Tommy Arnold is still strongly
advocating on the behalf of developers. Mr. Arnold has made a point
of
telling the adjacent neighbors that they do not have enough bodies and
opposition at these meetings compared to the Nalley case. That's
where we
need your help.
Call our County Commissioners and tell them we are against this type of
development and rezoning in our neighborhoods. Also a strong show
of
support is needed at Tuesday's Board of Commissioners meeting. Please
consider giving up a couple of hours of your time to help protect our
neighborhoods. We realize this may be an inconvenience but giving
up two
hours is a small sacrifice considering the hundreds of hours that volunteers
have given up to defend our neighborhoods in these cases.
The meeting will be held on Tuesday, March 22nd at
6:30pm at the Maloof Auditorium in downtown Decatur.
